Terms and Conditions

1. Acceptance of Terms

By accessing or using the PitStop Ops website (pitstopops.com) or purchasing any of our services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.

PitStop Ops is a hospitality operations consulting business owned and operated by Ricky Gutierrez, based in Central Florida.

2. Description of Services

PitStop Ops provides hospitality operations consulting services, including automation setup, workflow optimization, marketing systems, and ongoing operational support. The goal is to help food trucks, restaurants, bars, caterers, and cafes save time and increase efficiency through modern tools and proven systems.

We offer three consulting packages:

3. Payment Terms

All payments are processed through Stripe. By purchasing a consulting package, you agree to the following:

  • Setup fees are due in full at the time of purchase
  • Monthly fees are billed on a recurring basis via Stripe and will continue until cancelled
  • You are responsible for keeping your payment information current
  • All fees are listed in US dollars
  • Failed payments may result in suspension of ongoing services until payment is resolved

4. 60-Day ROI Guarantee

We offer a 60-Day ROI Guarantee: if we don't save you 10 or more hours per week within 60 days of starting your engagement, you receive a full refund of your setup fee.

The following conditions apply to this guarantee:

  • You must implement the automations and systems we recommend within the 60-day period
  • You must provide reasonable and timely access to the systems and platforms needed for implementation
  • You must respond to communications and provide feedback in a timely manner
  • The guarantee applies to the setup fee only, not to monthly recurring fees for services already rendered
  • Refund requests under this guarantee must be submitted in writing to ricky@pitstopops.com within 7 days of the 60-day period ending

5. Cancellation Policy

Monthly recurring services may be cancelled with 30 days written notice. To cancel, email ricky@pitstopops.com with your cancellation request.

  • Cancellation takes effect at the end of the current billing cycle following the 30-day notice period
  • Setup fees are non-refundable after the 60-Day ROI Guarantee period has passed
  • No partial refunds will be issued for unused portions of a monthly billing period

6. Intellectual Property

Any automations, workflows, systems, and configurations built as part of your consulting engagement will remain accessible to you. You retain access to all tools and systems set up in your accounts.

  • Templates, frameworks, and proprietary methodologies developed by PitStop Ops remain the intellectual property of PitStop Ops
  • You are granted a non-exclusive, non-transferable license to use these materials for your own business operations
  • You may not resell, redistribute, or share PitStop Ops proprietary materials with third parties

The PitStop Ops name, logo, and branding are the property of PitStop Ops and may not be used without prior written permission.

7. Limitation of Liability

PitStop Ops provides consulting services on an advisory basis. We do not guarantee specific financial results or outcomes beyond our 60-Day ROI Guarantee as described in Section 4.

  • Our total liability for any claim arising from our services shall not exceed the total amount you have paid to PitStop Ops in the 12 months preceding the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost revenue, or business interruption
  • We are not responsible for downtime, outages, or issues caused by third-party platforms (such as Stripe, Supabase, or other tools configured during your engagement)
  • Consulting recommendations are based on our professional expertise but do not constitute legal, financial, or tax advice

8. Client Responsibilities

To get the most out of our consulting services, you agree to:

  • Provide accurate and complete business information relevant to the engagement
  • Provide timely access to systems, platforms, and accounts needed for automation setup
  • Respond to questions, requests for feedback, and communications in a reasonable timeframe
  • Implement recommended changes and follow through on action items discussed during consulting sessions
  • Maintain account credentials and access securely

Failure to meet these responsibilities may affect our ability to deliver results and could impact the applicability of our 60-Day ROI Guarantee.

9. Communication Consent

By submitting your information through any form on our website (including the operations audit form and consultation request form), you consent to receiving communications from PitStop Ops, including:

  • Email nurture sequences with tips, insights, and service information
  • Transactional emails related to your account or services
  • SMS messages (if you provided a phone number and opted in), including appointment reminders and follow-ups

You may opt out of these communications at any time:

  • Email: click the unsubscribe link in any email, or visit our unsubscribe page
  • SMS: reply STOP to any text message

10. Website Use

When using our website, you agree not to:

  • Use the website for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to our systems, databases, or accounts
  • Submit false, misleading, or spam content through our forms
  • Interfere with the website's functionality or security
  • Scrape, copy, or reproduce website content without written permission

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding relating to these terms shall be brought in the courts of the State of Florida.

12. Dispute Resolution

In the event of any dispute arising from these terms or our services, both parties agree to first attempt to resolve the matter through good faith negotiation. Either party may initiate the dispute resolution process by sending written notice to the other party describing the nature of the dispute.

If the dispute cannot be resolved through negotiation within 30 days, either party may pursue other remedies available under applicable law.

13. Modifications to Terms

We reserve the right to update or modify these Terms and Conditions at any time. When changes are made, we will update the "Last updated" date at the top of this page. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.

For material changes that significantly affect your rights or obligations, we will make reasonable efforts to notify you via email.
